Governing legislation

Port of Melbourne Corporation (PoMC) was established by the Victorian Government under the Port Services Act 1995 (Vic) (this version incorporates amendments as at 1 July 2004).

Portfolio responsibility rests with the Victorian Minister for Roads and Ports. However, on a range of matters affecting PoMC, the Minister has joint responsibility with the Victorian Treasurer.

Ports regulation review 2004

In 2004, the Essential Services Commission (ESC) conducted an enquiry into the regulatory arrangements in Victorian commercial ports. This was required under Section 53 of the Port Services Act 1995 .

In June 2004, the ESC submitted its Final Report on its findings to the Minister for Finance, the Minister responsible for the Essential Services Commission Act 2001 (Vic), and in March 2005 published their Price Monitoring Determination for the Victorian Ports. The report and determination documents can be viewed on the ESC’s website.
